FORMER Director General of the National Identification Authority (NIDA) boss, 7 others in court over 1.2bn/- fraud

FORMER Director General of the National Identification Authority (NIDA), Dickson Maimu, and seven other senior officials appeared before the Kisutu Resident Magistrate’s Court in Dar es Salaam yesterday.
Other accused persons are Avelin Momburi, the authority’s Director of Business Support; Benamini Mwakatumbula, Manager of Finance and Accounts; Joseph Makani, Budget and Estate Manager; George Ntalima, Transport Officer and Sabina Raymond, Director of Legal Services.

The rest are Xavery Kayombo, whose official capacity was not disclosed and Astery Ndege, the Director of Aste Insurance Brokers Company Limited.

The accused persons are also facing charges relating to use of documents intended to mislead principal and conspiracy to commit an offence.

Before Principal Resident Magistrate Respicious Mwijage, the accused persons were not allowed to enter plea to the charges because they are charged under Economic and Organised Crime Control Act.

They were all ordered to go to remand until August 31, when the case will be mentioned. Investigations into the case, according to the prosecution, led by Senior State Attorney Awamu Mbangwa, have not been completed. The magistrate ordered that bail would be considered by the High Court since the amount involved in the matter exceeded 10m/-.

But he said he would deliver a ruling on bail application for Mobuli and Makani on Friday, following arguments that the two accused persons do not face economic charges like the others.

Other members of the prosecution team are Mr Leonard Swai, Ms Janeth Machuria, Mr Joseph Kiula and Ms Fatma Waziri. The prosecution alleged that on diverse dates between 2010 and 2015, being employed in the public service, Maimu and Mwakatumbula abused their positions by effecting payments to Gotham International Limited worth 5.175 million US dollars and 6m/-.

It was alleged that the accused did not use selling exchange rates established by the Bank of Tanzania (BoT) in violation of Clause 19.3 of the agreed contract between NIDA and such company, thereby causing the same to obtain undue advantage and causing loss of 167,445,676.67.

It is alleged further that on diverse dates between August and November, 2012, at NIDA, Maimu, Mwakatumbula and Ntalima, abused their positions by authorising and effecting inflated payments of insurance premium to Aste Insurance Brokers Company Limited amounting to 117,020 US dollars.

The prosecution told the court further that between February and April 2012, at NIDA offices, while discharging their duties, Mombuli, Mwakatumbula and Ntalima abused their positions by effecting 22,582,281/- to the insurance company, thus causing it to obtain undue advantage of the said amount.
It is alleged that Ndege, being the director of the insurance company contracted by NIDA to provide insurance services, with intent to defraud or deceit his principal, intentionally used several invoices containing false particulars purporting to be insurance premium of four per cent of the insured amount.

As a result, the prosecution claims, the insurance company obtained undue advantages. The court heard further that Maimu, Mwakatumbula, Ndege and Ntalima, by their willful acts, caused NIDA to suffer a loss of 55,312,800/-.

The prosecution told the court that on diverse dates between 2012 and 2013 at NIDA offices, while discharging their duties, Maimu, Mwakatumbula and Makani intentionally abused their positions by authorising and effecting additional payments of 24 million US dollars to Iris Corporation Berhad.

It was alleged that such payments were given for a proposed new schedule to fast track delivery of cards and equipment without amendments of the existing contract - in violation of Clause 45 of the General Conditions of Contract between NIDA and the company. Such act conferred the corporation undue advantage of the said amount.

In June 2013 at NIDA offices, Mwakatumbula, Ntalimamand Kayombo allegedly conspired to commit offence under the Prevention and Combatting of Corruption Act, which is using documents, intended to mislead principal.

It is alleged that in June 2013 at NIDA offices, Mwakatumbula and Ntalima, with intent to defraud their principal, NIDA, used a minute sheet containing false particulars purporting to show that Gwiholoto Impex Limited deserved payments of an outstanding balance of 45,515,961/- while it was false.

The prosecution further alleged that in June 2013, at NIDA offices, while discharging their duties, Mwakatumbula and Ntalima abused their positions by authorising and effecting payments of the said amount to Gwihololo Company, thus causing the same to obtain undue advantage of the amount.

It was also alleged that in June 2013, at NIDA offices, by their willful acts, Mwakatumbula, Ntalima and Kayombo caused the authority to suffer loss of the said amount.

The court was told also that between August 2010 and November 2011, at NIDA, Maimu and Raymond intentionally abused their positions by procuring the School of Law, formerly Faculty of Law of the University of Dar es Salaam (UDSM), in association with M-0S Law Partner, a provision for consultancy services.

Such services, it is alleged, related to review of existing legislations and propose a legal framework to support the implementation of the National Identification programme, knowing that there was in existence of a similar contract between NIDA and Gotham International Limited.

The prosecution alleged that as a result, such company, Gotham Company, obtained undue advantage of 901,078,494/-. Between November 2011 and April 2012, at NIDA, by their willful acts, Maimu and Raymond caused the Authority to suffer loss of the said amount

He said his government was on its mark as it starts implementing the election manifesto, insisting that all the money will be allocated to the intended projects without fail.

“We have already set aside money for the construction of the bridge to facilitate passenger transportation and movements of goods. The Kigongo-Busisi one will be just like that of Kigamboni and its construction is underway,” he told the rally.

Dr’ Mwaka still at large, sets police in ‘hide-and seek game'

“Police operatives are still tracing him; we will arrest him whether in Dar es Salaam or anywhere in the country. He is aware that we are looking for him and he has been dodging us,” the Ilala Regional Police Commander, Salum Hamdun, told the ‘

The RPC would not go much into details of the manhunt, stressing, however, that the police were working around the clock to arrest him.“After Mwaka learned that we were looking for him, he could have presented himself over but since he has chosen to hide, then we will go after him,” the Ilala police boss told this paper in a telephone interview.

The order of arrest for the self-proclaimed doctor was issued last Friday by Deputy Minister for Health, Community Development, Gender, Elderly and Children, Dr Khamis Kigwangalla, after an impromptu visit at the herbalist’s clinic located at Ilala in Dar es Salaam.

Among others, Mwaka is accused of providing services to people even after his clinic, Foreplan Clinic, was deregistered on July 11 by the Traditional and Alternative Health Practices Council (TAHPC) for violating regulations and guidelines of the council.

Following the ban on the clinic, Mwaka remained defiant by changing the name of the treatment centre from Foreplan Clinic to Foreplan Tanzania Limited and continued to offer services and promote the same through television and radio programmes.

Over a fortnight ago, the Minister for Health, Community Development, Gender, Elderly and Children, Ms Ummy Mwalimu, said the government had informed the police and communications industry regulator to take appropriate actions against ‘Dr Mwaka’ and other herbalists for defying government orders.

“The Traditional and Alternative Medicine Act of 2002 prohibits practitioners in the field to advertise their products and facilities; only adverts approved by the Traditional and Alternative Health Practices Council (TAHPC) are allowed.

“However, some of the herbalists have been presenting to television and radio stations different programmes for broadcasting from those approved by the council,” Ms Mwalimu observed then during an interview with this newspaper. Efforts to get comment from ‘Dr’ Mwaka were not successful yesterday as his known mobile phone was not reachable.

A follow up by the ‘Daily News’ has found out that even the recently deregistered traditional and alternative clinics have continued to air special programmes on television stations, particularly on Channel Ten and Star TV.

Sources privy to ‘Dr’ Mwaka’s business confided to this newspaper that after he had his operating licence as a herbalist revoked, he registered another company known as Foreplan Tanzania Limited, which has taken over from Foreplan Clinics.

“(Dr) Mwaka now describes his new company as one dealing with cosmetics and food nutrients; he is apparently evading the long arm of the law since the new company is not subjected to provisions of the Traditional and Alternative Medicine Act of 2002,” the source stated.

“Dr Mwaka’s clinic is among the three that were deregistered by TAHPC on July 11 while three others were suspended for six months for violating regulations, policy and guidelines set by the counci

Drama as Lissu heads for the dock

HIGH tension yesterday surrounded the Kisutu Resident Magistrate’s Court in Dar es Salaam when Singida East Constituency’s Member of Parliament (MP), Tundu Lissu, was arraigned for the third time to answer three seditious and court contempt charges.

However, the prosecution attempt to block Lissu’s bail failed after the court dismissed grounds of objection. He was therefore granted bail on self bond that he will sign 10m/- bail bond

.The MP under Chadema ticket is accused of abusing President of the United Republic of Tanzania, Dr John Magufuli and showing disrespect to the court following his alleged conduct of issuing seditious words after attending his two other cases on Tuesday before the same court.

Armed with guns, clubs and other weapons, the police, both plain clothes detectives and others in uniform, beefed up security at the court premises starting early in the morning. They sealed all entrances and nobody, except a few persons were allowed to enter the compound.

Even those allowed to get into the court areas were subjected to heavy searching by the police officers. Several members from the opposition party, who wished to witness the arraignment of the outspoken lawmaker, were denied such access and ordered to leave the area without delay.

About five people believed to be members of Chadema were arrested and taken to Central Police Station for other legal measures when they attempted to defy the police directives.

However, several other top leaders from the opposition parties and MPs were allowed to witness Lissu’s arraignment.

They included Chadema’s National Chairman and leader of Opposition camp in Parliament, Freeman Mbowe; NCCRMageuzi National Chairman Francis Mbatia; MPs for Ubungo, Kawe and Ukonga, Saed Kubenea, Halima Mdee and Waitara Mwita, respectively.

Lissu was brought to the court premises to face the charges at around 3.00pm, but his arraignment to the dock in an open courtroom was delayed until 5.00pm, following a legal technicality raised by the prosecution on whether it was proper for advocate Peter Kibatala to represent him.

Initially, Principal Resident Magistrate Cyprian Mkeha, who is hearing the case, had directed the prosecution to read first the charges against the accused person and after he had entered plea, the prosecution could thereafter, raise their concern on the matter.

The two parties, prosecution and defence, had to conduct several consultations to reach a consensus on the matter, but no agreement was reached because it was maintained that advocate Kibatala would be among prosecution witnesses and could not at the same time defend the accused person.

It was at that point in time when the court decided that without reading the charges to the accused person, the court would have no any jurisdiction to entertain any concern.

Having received such guidance, the court decided to read the charges first to the accused person, though under protest.

Reading the charges, the prosecution led by Principal State Attorney Faraja Nchimbi, Senior State Attorney Mutalemwa Kishenyi and State Attorneys Paul Kadushi and Wankyo Simon, told the court that the MP committed the offences on August 2, this year, at the Kisutu Resident Magistrate’s Court.

It is alleged that with intent to bring into hatred to the citizen of the United Republic of Tanzania against the president, Lissu uttered seditious words saying, “Ukitaka kujua kuwa Magufuli ni dikteta uchwara ni pamoja na kauli zake.”

The prosecution told the court that on the same day and place, the legislator uttered seditious words with reference to the other two cases he is facing before the court that, “kesi na mashitaka yenyewe ni ya kipuuzi puuzi na kimagufuli magufuli.”

It is alleged further that on the same day and place, with intent of showing disrespect of the court regarding the other two cases he is facing, Lissu uttered words showing, “siwezi kufungwa…. kesi na mashitaka yenyewe ni ya kipuuzi puuzi na kimagufuli magufuli.”
